<p>A settlement has been reached in a class action lawsuit between Kyodai Sushi Rock Café, Inc., Tae N. Oh, and Kyung Eun Oh (“Defendants”) and certain individuals who worked for Defendants as Servers in Orange, Florida, between February 22, 2017, and February 2, 2023. The lawsuit alleges that Defendants violated the Florida Minimum Wage Act (“FMWA”) by allegedly failing to provide Servers adequate notice of the tip credit, allegedly failing to compensate Servers the applicable reduced wage, allegedly requiring Servers to work certain hours off-the-clock, and allegedly allowing managers to receive portions of a tip pool that Servers were required to contribute toward. The case is Sparks, et. al. v. Kyodai Sushi Rock Café, Inc., et. al., 4th Judicial Circuit Court Case No. 2022CA001268, currently pending in the 4th Judicial Circuit Court in and for Clay County, Florida. The proposed Settlement is not an admission of wrongdoing by Defendants, and Defendants deny that they violated the law. The Court has not decided who is right or wrong. Rather, to avoid the time, expense, and uncertainty of litigation, the Parties have agreed to settle the lawsuit. The Settlement has been preliminarily approved by a court in South Florida.</p>
